Competition and Free Draw - Official Rules and Regulations

Before entering the Your talent for DJ Shadow Re Mix Competition, please read and indicate that you accept the Official Rules and Regulations, the Privacy Policy and the Site Terms. If you do not accept them, you are not eligible to participate in the Contest.

ELIGIBILITY
DJ ShadowRemix Competition (hereinafter referred to as "the Contest"), brought to you by The Nokia Corporation., Espoo, Finland, (hereinafter referred to as the "Sponsor") will be governed by these rules (the "Official Rules").
In order to be eligible to participate, you must be at least 15 years of age or of the legal age in your country of residence. No purchase is necessary to enter or win. The Contest is open to participants/contestants (hereinafter referred to as “Participants”) globally. Anyone under 18 who wins the Grand prize must be accompanied on the trip by a person over 18 years of age and have written consent from a legal guardian.
The Sponsor, its subsidiaries, affiliates and agents reserve the right at any time to verify that any and all Participants meet the eligibility requirements in any manner deemed appropriate. The employees and directors of the Sponsor and/or its licensees, advertising, promotion or production agencies and provider companies (and their respective IRS dependents, immediate family mem-bers (spouse, children, parents, siblings) and individuals residing in their same household) are not eligible to participate. By participating, Participants agree to these Official Rules and the decisions of the judges, which are final and binding in all matters relating to this Contest.
The Contest (as defined on later in this Document) are void wherever prohibited or restricted by any mandatory national, state or other government laws in form and language as provided herein and is subject to all applicable mandatory federal (national), state and local laws.

PROGRAM PERIOD
The Contest begins on 24th June 2008 and the Closing Date for the Contest is 16.00 GMT on 5th August 2008 (hereinafter referred to as the "Program Period"). Winners will be announced publicly on 12th August on the Nokia Trends Lab website.
Winners will be notified via the email they have provided and via the mobile telephone number they have provided by 12.00 GMT 7th August. Nokia will make every effort to contact prizewinners within this period. The prizewinner must acknowledge his/her win to the Sponsor by 12.00 GMT on 8th August, 2008. In the event of failing to do so, the Sponsor shall select another winner based on the selection criteria above or dispose of the Prize in any way it deems fit. The Prizes (excepting the Grand Prize) will be sent to winners by mail or other means as determined solely by the Sponsor. The Sponsor shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) in the delivery of the Prize to the winner.

HOW TO PARTICIPATE
To enter the Contest you need to submit your name, valid email address and mobile phone number. If this required information is not given, your incomplete entry will be considered invalid. By entering into the Contest you acknowledge and agree that winners' names and stories may be used in the marketing of the Nokia phones and related products. This data will only be used for marketing purposes if Nokia has asked the participants for permission to use it. Nokia will contact the winners via email.

CONTEST MECHANICS
In order to access the Site, you must have access to the World Wide Web (Internet) provided by an Internet Service Provider (hereinafter referred to as an "ISP") of your choosing and you must pay any applicable ISP, operator, service and other fees for such access. Any registration that, in the sole discretion of the Sponsor, is considered inappropriate or unsuitable for publication will be deemed ineligible by the Sponsor. The Sponsor reserves the right to invalidate all registrations in any manner it deems appropriate. Registrations that are found to be irregular (as solely determined by the Sponsor) will cause those registrations to be deemed void and the Participant to be disqualified.

THE INFORMATION SUBMITTED BY YOU
The information submitted by you will only be used by the Sponsor, in accordance with the applicable data protection regulations and the Privacy Policy of the Site (http://www.nokia.com/link?cid=PLAIN_TEXT_5582), for the purposes of administrating your participation in the Contest. By entering into the Contest you acknowledge and agree that winners' names and stories may be used in the marketing of the Nokia phones and related products. This data will only be used for marketing purposes if Sponsor has asked the participants for permission to use it. Sponsor will contact the winners of the Prize Draw via email.
By participating in the Contest and submitting your name, address, city and country of residence, mobile phone number and e-mail address (hereinafter referred to as "Personal Information") you are acknowledging that you fully accept and give your unambiguous consent that the Personal Information collected in connection with your use of the Site and participation in the Contest may be transferred across international borders to server locations supporting the Site (including but not limited to transfers from those locations back to the country of your registration) for the purposes of administrating your participation in the Contest and storing the Personal Information submitted by you in the relevant database during the Program Period, which may be located in Italy. You have the right at any time during the Program Period to review, correct or remove the Personal Information submitted by you following the guidelines provided in the Site's Privacy Policy.

PRIZES
Contest Grand Prize: One (1) Trip for 2 to a Nokia Trends Lab event in Europe including return flights, accommodation in at least a 3 star hotel for 1 night, transfers to and from the hotel and to the event, €150 spending money and VIP passes.
This will be awarded to the entrant who, in the judgment of DJ Shadow, has created the best re-mix in the DJ Shadow Re-Mix Competition. Judging will be based on the quality of entry, creativity, and clarity of the music sample, but the decision is completely in the sole discretion of DJ Shadow.
Runner up Prizes: One (1) of five (5)-Nokia N95 multimedia computers each. These will be awarded to the top 5 runner up entrants as chosen by DJ Shadow.
Taxes, if any, related to the Prizes are the sole responsibility of the winner. Notwithstanding the above, Sponsor is nevertheless responsible for the applicable Finnish lottery tax, if any. All costs associated with the prizes, including but not limited to operator subscription fees that are not in-cluded in a prize, shall be paid by the prizewinner. The Grand Prize should be taken within 6 months of the closing date. Sponsor will supply a list of events to the winner from which he/she should make his/her preferred choice. The Grand Prize nor the Prizes cannot be assigned, transferred, redeemed for cash, or substituted except by the Sponsor, who may, at its sole discretion, substitute any Prize with one of comparable value if the advertised Prize becomes unavailable for any reason.

Sponsor assumes no liability for technical problems associated with sending and delivery of MMS via your operator. Taxes, if any, related to the Prizes are the sole responsibility of the winner. Notwithstanding the above, Sponsor is nevertheless responsible for the applicable Finnish lottery tax, if any. GENERAL RULES
Participation constitutes consent (a) to comply with these Official Rules, the Site's Site Terms and Privacy Policy, and (b) that the Participant release and hold harmless the Sponsor, its subsidiaries, affiliates, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents from any and all liability or any injuries, including death, loss or damage of any kind arising in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any Prize or participation in the Contest or any Contest-related activities. If a winner is found to be ineligible or not in compliance with these Official Rules, the winner's Prize will be forfeited and an alternate winner selected.

RIGHT TO USE ANY SUBMITTED CONTENT
By submitting, and upon such submission of, any information or materials such as (but not limited to) feedback, data, text, software, music, sound, photographs, likeness, graphics, video, messages, voice, answers, questions, comments, suggestions, scores, hints, strategies, concepts, designs, ideas, plans, orders, requests or the like, or any other material (hereinafter referred to as the "Content") to the Sponsor or through the Site, for example, by e-mail, SMS, and/or MMS, you license and grant to the Sponsor a non-exclusive, royalty-free and free of charge, perpetual, worldwide, irrevocable, and fully sub-licensable right to use, reproduce, copy, modify, adapt, communicate to the public, make available, publish, translate, create derivative works of, distribute, and display such Content or any concept described in it throughout the world in any media, product and/service, including, without limitation, game decks, games, consoles, wireless devices, mobile phones and any related products, services and accessories, advertising, marketing and promotional materials, and digital reproductions, without compensation, restrictions on use, acknowledgement of source, accountability or liability, and with waiver of all moral rights and rights of attribution, integrity and identity to the extent permitted by mandatory laws.
With regard to such Content submissions, you understand and agree that you are solely and fully responsible for any and all aspects of the Content submitted, including but not limited to its legality, appropriateness and non-infringement of third party intellectual property rights, and the Sponsor shall not be liable in any way for such Content. The Sponsor shall have no obligation to monitor any of the Content provided by you to the Sponsor, but may do so at its discretion.

RULES FOR CONTENT SUBMISSIONS
With regard to the Content submissions, you understand and agree that you are solely and fully responsible for any and all aspects of the Content submitted, including but not limited to its legality, appropriateness and non-infringement of third party intellectual property rights, and the Sponsor shall not be liable in any way for such Content.
Further, with regard to any and all Content submissions, you agree that:
(a) you will not post, publish, transmit, distribute, or upload any information through the Site or Contest that is unlawful or fraudulent, or violates or infringes any patent, copyright, trademark, trade secret or any other proprietary intellectual property rights of others. In connection therewith you represent and warrant to the Sponsor that your content does not infringe the trademarks, copyrights, patents, or other intellectual property rights of any third parties;
(b) the Content will not contain any material that is unlawful, libelous, slanderous, defamatory or invasive of another person's right of privacy or right of publicity, or that the Sponsor may reasonably deem harmful, vulgar, obscene, derogatory, pornographic, abusive, harassing, threatening, hateful, objectionable with respect to race, religion, creed, national origin or gender, or otherwise unfit for publication;
(c) the Content will not promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous nor will it defame, misrepresent or contain disparaging remarks about Nokia or its products, or other people, products or companies;
(d) you will not send any such messages to any other user or the Sponsor that contain vulgar, abusive or otherwise inappropriate language;
(e) you will not disrupt the flow of discussion with vulgar, abusive or otherwise inappropriate language, or by other means, including without limitation hitting the return key repeatedly or posting repetitive text;
(f) you will not, without first using reasonable efforts to scan and remove any viruses or any contaminating or destructive features before submitting any Content to the Site(s) and Contest, post, publish, transmit, distribute, or upload any information through the Site(s) or Contest that contains a virus, Trojan horse, "sniffer" routines, backdoors, worms, time bombs, bots, or any other harmful software code, file, program or programming routine, or other contaminating or destructive features;
(g) your postings or Content submissions shall not cause injury or harm to any persons or entities;
(h) you will not use the Site to "stalk" or harass another person and your Content and use will not suggest or encourage to any illegal activity;
(i) your use of the Site will not compromise the security or integrity of the Sponsor's computer systems, networks or web site(s) or servers, whether by allowing intruders into the same, introducing viruses or other threats, imposing a disproportionate or unreasonably large load on this Site or its infrastructure, or using any computer programming routine, file or device to damage or interfere with the operation of the Site;
(j) you will not post, publish, transmit, distribute, or upload through the Site(s) or Contest any unauthorized or unsolicited bulk e-mail solicitations, chain letters, advertisements, marketing or promotional materials, "junk mail", "spam", pyramid schemes or any other solicitations or communications, including without limitation spamming the Sponsor or other users of the Site(s), or use or collect other users e-mail addresses or phone numbers, or other users information or postings, or use the Site to perform any data collection, extraction or mining or gain or attempt to gain unauthorized access to Sponsor or any site visitor's computer system;
(k) you will not register with or otherwise use a false name, identity or e-mail address, impersonate any person or entity, including without limitation the Sponsor or its licensors' personnel, falsely state or otherwise misrepresent your affiliation with a person or entity, use another user's password (if applicable), forge headers or otherwise manipulate identification information to falsify or disguise the origin of any Content, or falsify or misrepresent any Content with respect to submissions to the Site, and
(l) you will follow all applicable laws and regulations applicable to your use of the Site and/or Content submission. Such laws and regulations include, without limitation, those governing copyright, defamation, privacy, publicity and the access or use of others' computer or communication systems.
Additionally, you agree that you will use good judgment and exercise discretion in choosing appropriate subjects and subject matter for any photo or video submissions to the Site(s) or Contest. Remember that privacy laws may protect individuals with respect to their being photographed or videotaped, so please respect the privacy of others by asking for and obtaining their consent to be photographed or videotaped, as well as for your submissions of photos or videos to the Site and Contest.

INTERNET
Neither the Sponsor nor its subsidiaries, affiliates or agencies are responsible for lost, late, misdirected, unintelligible, interrupted or unavailable satellite, network, server, ISP, website, telephone or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, corrupted, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture any such information. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods, and disqualify any entrant using such methods. The Sponsor is not responsible for injury or damage to Participants' or to any other person's computer related to or resulting from participating in the Contest or downloading materials from or use of the website. Should any portion of the Contest be, in the Sponsor's sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, the Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest, and select the winner from entries received prior to action taken or as otherwise deemed fair and appropriate by the Sponsor. The Sponsor is not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest, and assumes no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, theft or destruction, or unauthorized use of the Site or other applicable sites.

MISCELLANEOUS
These Official Rules are governed by the laws of Finland.
To the maximum extent permitted by applicable law, the Sponsor reserves the right at its sole discretion to amend, withdraw or revise these Official Rules and the Prizes at any time without notice and in such event the Sponsor shall not have any liability whatsoever.
You acknowledge and agree that you must conduct yourself in a mature and decent manner to other Participants, chat room spectators, and the Sponsor. You acknowledge and agree that the Sponsor is permitted to automatically disqualify any Participant that is not conforming to these Official Rules or is acting in an unreasonable manner (to be determined in the sole and absolute discretion of the Sponsor on a case by case basis).
You acknowledge and agree that no form of cheating will be tolerated. Any persons found cheating, as determined in the sole and absolute discretion of the Sponsor, will immediately be disqualified from the Contest. Cheating includes but is not limited to tampering, hacking of website, playing the Contest without meeting the eligibility requirements, using any automated software or device to gain an advantage during the Contest, using any cheat codes, exploiting any software bugs, use of the Contest beyond the defined rules of the Contest, attempting to disable or overwhelm any of the Sponsor sites, attempts to disrupt any portion of the Contest, including but not limited to allowing somebody else to use your Personal Information tampering with entry process or operation of promotion or website.

CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY OF THE SPONSOR SITES OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS; AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

You acknowledge and agree that all disputes in relation to the Contest, including but not limited to scoring, placing, eligibility, cheating, advancement and any other issue related to the Contest shall be determined in the sole and absolute discretion of the Sponsor, and that such a decision by the site operators or event officials shall be final and binding.

CONTEST OF SKILL
You acknowledge and agree that the Contest for the Grand Prize is one of skill not chance, and that you have little chance of winning without acquiring the skill to make music.
